REFERRAL SCHEME These terms and conditions set out the scheme for recommending a friend to us. It is applicable for the referral of another person for a position advertised on the Carpe Diem Legal website (‘the Website’). Referring a person for a position 1.1 If you think someone you know (the "Candidate") may be interested in applying for a position advertised on the Website, then you can refer that person to us. You can refer unlimited numbers of people for each position advertised. 1.2 Before you can refer a Candidate for a position for the first time you must register on the Website by completing the online registration form. Once you have submitted your details, an e-mail will be sent to you confirming your User ID and successful registration. 1.3 Your details will be stored and you are responsible for keeping your personal information correct and up to date. If your details change, you undertake to update us by contacting us via email or letter as soon as reasonably possible. 1.4 On each occasion you refer a Candidate to us you will be asked to provide the Candidate's name and email address to us. By referring a Candidate to us you confirm that you have obtained the consent of the Candidate to do so. 1.5 On receipt of your referral, we shall send an email to the Candidate confirming that you have referred them for a position advertised on the Website. 1.6 If more than one person refers the Candidate for the same position, the referred Candidate will be asked to confirm which referring candidate is to be considered the referrer and therefore which referrer should receive the Reward. If the referred candidate fails to confirm which referrer should receive the Reward, by the time they commence their new employment, the Reward will be apportioned equally between the referring candidates. 1.7 There is no fee payable to us for registration on the Website or for your use of the Services. You will, however, be responsible for any costs and expenses incurred by you for use of the Services including, without limitation, any telephony costs or charges for other communication services. 1.8 We may decide, at our sole discretion that the percentage of Reward you receive will be less than the amount set out in paragraph 2. Examples of when we might do this are if we consider that your emails are spam emails, or that you have not obtained the explicit consent of a Candidate to their referral for a position or if we receive a number of complaints or blacklists about you from Candidates or others. The Reward 2.1 We offer a referral reward in the form of vouchers, subject to availability at your chosen outlet, (the "Reward") for each candidate recommended to us by, and confirmed as such by the referred candidate. A successful referral is defined as where a Candidate you refer for a position is (a) hired as a result of an introduction by Carpe Diem Legal Ltd; and (b) remains employed in that position for at least ten weeks from the date of commencement of that employment. The amount of Reward voucher(s) applicable is subject to the amount of the starting salary (“placement”) of the placed candidate, as follows:
2.2 If you make a successful referral, we shall contact you by email to notify you of this and arrange payment of your share of the Reward, subject to paragraph 2.1. However, while we shall make every effort to track the progress of referrals, we shall not be liable for a failure to contact you at the time of placement, or subsequently to notify you of your entitlement to claim a Reward or to make that Reward. We recommend that you maintain contact with your candidates and inform us when you believe you have made a successful referral. Email: recommendations@carpediemlegal.co.uk. When we are informed by you of a successful referral we shall use reasonable endeavours to verify this and pay the Reward where due. 2.3 Any communications regarding referrals, a Reward and payments due must be made to Carpe Diem Legal Ltd and not with the candidate’s new employer and nor should communication regarding the award of vouchers be entered into with the candidate. Failure to abide by this clause will nullify any right you may have to claim a Reward. 2.4 Reward will be by vouchers from your chosen outlet, and in accordance with the Reward levels set out at paragraph 2 above. Any costs and expenses incurred by you in respect of redemption of voucher(s) will be borne by you. Our Reward to you is conditional on our first having received payment of our fee from the employer for the position you successfully referred. 2.5 You are responsible for paying any tax which becomes due by you as a result of the Reward and indemnify us against any liability for tax due by you which results from such Reward. 2.6 You must claim your share of the Reward within 6 months of successful referral. If you do not, your right to receive payment will terminate.
Candidates 3.1 If someone refers a position to you we shall contact you by email and provide you with details which we have of the position in question, together with a detail of your nominated Consultant. If more than one person refers you for the same position, you will be asked to confirm to us who you wish to be considered as your Referrer, and can choose which should receive the Reward by notifying us prior to receiving any offer of a job through us. If you wish to apply for the position, you must send your curriculum vitae to us, via registrations@carpediemlegal.co.uk, direct to your nominated Consultant or by fax or post, indicating that you have come to us by way of referral. Only once we obtain your consent will we disclose your details to our clients. 3.2 We shall not become involved in any dispute which may arise between Candidate and Referrer in respect of eligibility or otherwise for Reward. If, however, you have legitimate concerns or complaints, you may direct those complaints or concerns to us in accordance with our Complaints procedure, a copy of which is supplied at the time of registration, a full copy of which can also be obtained upon request.
